Voters Care More About Health Care in This Election -- Sort Of
Perhaps that’s why Mitt Romney decided it was time to outline his positions on health care policy, which he did in a series of speeches and media appearances this week. The details weren’t new—his campaign laid out its health care platform months ago—but Romney was unusually thorough in discussing those details himself.
But those details probably won’t matter much. Data from the same pollsters who see health care scoring high also suggests that voters aren’t really talking about health care when they list it as an issue. In this election, health has become something of a proxy issue for voters’ larger views about the appropriate role of the federal government. For opponents, it’s a symbol of government overreach; for supporters, it’s a sign of how government can help solve people’s problems. Those preferences better reflect voters’ partisan preferences than they do their actual experiences with the health care system.
“The debates are becoming less practical, about people’s problems, and more about whether or not it’s the right thing for the government to do,” said Robert Blendon, a pollster and professor at the Harvard School of Public Health who studies public attitudes about the health care system.
That attitude often was expressed during the Supreme Court's arguments over the law in March. Elizabeth Mancha, a private investigator from Georgia, came to Washington for the arguments because she felt the health reform law "truly exemplifies how out-of-control the federal government has gotten. It's the big trophy on the mantle," she told the Associated Press.
The economy is still, by leaps and bounds, the top issue for voters. But health care is catching up. In recent surveys from the Kaiser Family Foundation, Reuters, and CBS, it occupies the No. 2 slot. (Other polls have it lower down, though it’s a concern that comes up in virtually all the open-ended issues questions.) That’s unusual. Health care hasn’t bubbled up to the forefront of voter concerns in several presidential cycles.
The public is strongly divided on President Obama’s 2010 health care reform law—as it has been since the bill first passed. Kaiser asks people whether they approve or disapprove of the legislation every month, and the trend has been remarkably flat—about 40 percent oppose the law and 40 percent support it nearly every month.
But the numbers behind that topline are revealing. Startlingly few people actually know what provisions are in the legislation, even though large majorities support provisions like preventive care without copayment or rules limiting insurance company overhead, when asked about them specifically. (The individual mandate at the heart of the Supreme Court case is the exception to that rule—a majority of Americans know it’s in the law and a majority oppose it.)
Large segments of the population also believe things that are simply untrue about the law. More than 40 percent of those asked in a March Kaiser poll said they thought the law had already been overturned by the Supreme Court or weren’t sure. Sixty-eight percent of Republicans told Kaiser that they thought the law creates a government-run health care system to compete with private plans. Forty-one percent said they thought it allowed a “government panel” to make decisions about end-of-life care.
“We know so much from our polling about how little people really understand about what’s in the law, it’s hard to say that it’s because they really hate what it does,” said Mollyann Brodie, Kaiser’s pollster. “It’s become a real rallying point for the opponents for what they think is wrong with government, and I think that’s very different from their views of the health care system and what’s wrong with the health care system.”
Brodie drilled down into that question in March, when she asked opponents of the law whether that opposition was more about “what you know about the health care law” or “your general feelings about the direction of the country and what’s going on in Washington right now.” More said the second than the first—38 percent to 27 percent—while 32 percent said it was some of both.
Frank Newport of Gallup, whose own polling has shown less interest in the issue, said his findings are consistent with that overall picture: People like individual provisions when asked about them specifically, but not the law itself.
“One of the things that Obama’s team probably didn’t recognize in 2010 is it was the gestalt,” he said. “The overall bundling together of these things under the aegis of the government is what people are responding to.”

Health Reform Debate Arrives in the Supreme Court: Why It's Not About Obama

Listening to the heated rhetoric coming out of Washington, you may think the three days of health care arguments at the Supreme Court that begin Monday morning are about whether President Obama should have the power to force Americans to buy health insurance and order states to double the size of Medicaid through his 2010 overhaul of the health care industry. They’re not.
For all the focus on the Obama in “Obamacare,” the constitutional question before the court is not whether the executive branch has the power to remake the health care market in the United States, but whether Congress does. It was, after all, Congress that passed the law with a supermajority, enacting provisions that will eventually penalize Americans who don’t buy insurance and increase the size of the Medicaid program.

That’s why many conservative jurists find it difficult to challenge the health care reform law’s constitutionality. On paper, Congress has a lot of power when it comes to controlling commerce in America, and Republican appointees from the D.C. circuit’s Laurence Silberman to former clerk to Justice Antonin Scalia and 5th Circuit conservative Jeffrey Sutton have argued powerfully that Congress is well within its bounds in regulating health care, which represents 1/6th of the national economy.
Article 1, Section 8, Clause 3 of the Constitution, commonly known as the Commerce Clause, gives Congress the power “…to regulate commerce with foreign nations, and among the several states, and with the Indian tribes,” and over the years that power has been found to be very broad. The two most significant precedents for congressional commerce clause power are Wickard v. Filburn (1942) and Gonzales v. Raich (2005).
In Filburn, the New Deal court unanimously found that the government could penalize even the most private economic behavior. The court ruled that an Ohio farmer had to pay a penalty for growing wheat for his own use because not buying on the open market could affect grain prices nationwide. In Raich, Justice Scalia wrote as part of a 6-3 majority that Congress needed the expansive power to ensure that its regulation of drugs nationally wasn’t undermined by California’s permissive dope laws.

But Congress can’t control every aspect of American life through its power over the economy. In two Rehnquist court precedents, US v. Lopez (1995) and US v. Morrison (2000), the conservative justices tried to rein in places where the Commerce Clause could be used by Congress. In Lopez, the court found activity to be regulated under the clause had to be economic in nature. In Morrison, Rehnquist argued that the Violence Against Women Act went too far in allowing rape victims to sue for civil damages in federal court because doing so would usurp state powers and “create a completely centralized government.”
Justice Anthony Kennedy is always a potential swing vote in close cases like health reform. Because Scalia ruled in favor of expanded commerce clause powers in Raich, the conservative stalwart is seen by some as a possible vote in favor of Obamacare, though his votes in Lopez and Morrison break the other way. Chief Justice John Roberts has been successful in finding large majorities on some controversial issues during his time atop the court. The easiest way to produce that in the case of Obamacare would be to find that a challenge to the individual mandate is premature, as no one has yet been forced to buy insurance, so the extent of any challenge to the law’s constitutionality remains unclear. That would allow both sides of the court to punt on the issue until 2014, when the law comes into full effect.
A ruling is not expected on Obama’s health care reforms until late June. But however the justices probe the case this week, only outside commentators and political activists will be talking about the question of Obama’s power to control the health care market.

The Truth about Diet and Weight Loss
I want to talk tonight about weight loss. It's a subject everyone is worried about. And the problem is that diets don't work. Everybody has tried a diet. I haven't met a person yet that's hasn't tried something, from kids to people in their eighties; everybody has tried some kind of diet and they just don't work. In recent studies when they looked at a lot of their major diets (some good one's, Atkins, The Zone), they put them all together statistically and found a ten pound weight loss on average. Now, these people lost a hundred pounds and gained it back of course. But, all that work, all that money, all those videos, for ten pounds of weight loss?
So the truth is, we have to find a life style that will allow you to stay at a weight that is healthy for you. That's a much different way of thinking than all this crash dieting that goes on. What you have to learn is how to take care of yourself; you have to learn the appropriate foods; you have to make better choices. That's the only way it's going to work.

How Hospital Mergers Increase Health Costs, and What to Do About It

Last summer, I penned a blog post entitled “Hospital Monopolies: The Biggest Driver of Health Costs That Nobody Talks About.” It ended up being one of my most widely-read pieces last year. “I agree that changing the way we buy health care is important,” I wrote then. “But there’s an entire other side to that equation that we completely ignore: changing the way we sell health care.”
In November, the Massachusetts Association of Health Plans asked me to speak at their 2011 annual conference, on the topic of hospital consolidation. Given Massachusetts’ central role in the debate over health reform, and the top-notch health policy thinkers in the Boston area, I readily accepted.
In the 31-minute video below, I cover a number of historical topics, including: (1) how hospital mergers spiked in response to pressure from insurers to reduce health spending; (2) how early studies from economists failed to identify how hospital mergers drive up the price of health care; (3) how newer studies suggest that concentrated hospital markets lead to pricing increases of as much as 44 percent; (4) how government-subsidized health programs, such as Medicare, drive the problem of hospital consolidation. In the second half of the talk, I discuss what can be done about the problem. There are basically two plausible approaches: (1) increase the market power of payors, either using single-payer health care or private insurance monopsonies; or (2) decrease the market power of providers, so that both payors and providers are equally fragmented. To me, option (2) makes much more economic sense, and is also more politically practical than trying to achieve single-payer health care.
However, as I discuss in the talk, the problem is that when the U.S. Department of Justice and the Federal Trade Commission have tried to block anti-competitive hospital mergers in court, judges have sided with the hospitals, against the officials at DOJ/FTC. So judges need to do a better job of understanding the economic evidence that weighs against hospital mergers.
In addition, we need to be mindful of how accountable care organizations, or ACOs, could worsen provider consolidation. We need to modernize the certificate-of-need regulations, and other laws, that stymie the construction of new hospitals that can compete with the well-connected incumbents. And we need to harmonize state medical licensing laws, so that insurers can send their patients to cheaper providers across state and national borders.
I got some excellent questions in the Q&A portion of the talk. Nancy Turnbull of Harvard asked me: in places where the “horses have already left the barn” and the hospitals have already merged, what can we do about it? Lynn Nicholas, CEO of the Massachusetts Hospital Association, asked: aren’t insurer monopolies also a problem? Others pointed out the fact that longer-term trends of decreasing hospital utilization are also driving consolidation, which makes it harder to justify building new hospitals.
Watch the video to see how I responded. The bottom line is not reassuring: it’s that there are no simple solutions to this very serious problem, which is why need to pay far more attention to it than we do.
